Agano National Party Urges Government to Slow Down on Proposed Religious Organisations Bill



Agano National Party has called on the government to halt and reconsider the proposed Religious Organisations Bill, No. 44 of 2024, warning that it could undermine constitutional freedoms and allow undue state interference in religious affairs.

In a statement issued by its Secretary General on behalf of the party leadership, Agano urged the Executive, Legislature, and policymakers to proceed cautiously and conduct wide public consultations in line with Article 10 of the Constitution, which outlines the national values and principles of governance.

The party argued that, as currently drafted, the Bill risks “muzzling churches” and could in future be misused by hostile regimes to control religious organisations. Agano warned that such control would threaten the freedom of worship guaranteed under Article 32 of the Constitution.

“It should be remembered that Article 8 of the Constitution provides that there shall be no State religion, and that all law-making must respect religious freedom,” the party said, cautioning against legislation that could blur the line between the State and religious institutions.

Agano further noted that religious organisations are already legally recognised and regulated under the Societies Act (Cap. 108), pursuant to Article 36 of the Constitution, which guarantees freedom of association. The party called for full and effective implementation of the existing law instead of introducing new regulatory frameworks.

The statement also emphasised that any limitation of fundamental rights and freedoms must strictly comply with Article 24 of the Constitution, which sets clear conditions under which such limitations can be imposed.

The party urged that religious leaders at all levels be allowed to determine the future of religious organisations without undue interference from the State.

In closing, Agano National Party extended Christmas and New Year greetings to Kenyans of all faiths, including the youth, wishing them a Merry Christmas and a Happy New Year.
